The products and services offered here are aimed exclusively to corporate clients. These Terms of Use govern the purchase of products and services made through the website openshop.gr, operated by OpenShop Foundation and located on the street Magriotou 3, Nea Smyrni Attica, Greece, with GEMI number: 66799303000 and VAT ID: 113540174.

OpenShop Foundation contracts only with legal entities and individuals with a valid and active professional VAT ID who have reached the age of 18 years. If these conditions are not met, no contract is concluded.

Make sure that you have read and understood the following terms, as your use, and any transaction you make through the above website is subject to the following terms and implies that you have accepted all of its Terms of Use.

OpenShop Foundation reserves the unilateral right to modify or update these Terms of Use and undertakes to inform users about any modifications and changes through this website. It is clarified that the changing terms do not cover previous orders.

1. Information provided related to products and services

OpenShop Foundation undertakes all necessary measures for complete and valid information provided on its website openshop.gr on the existence of the essential features described on a case-by-case basis for each product and service that is available from the OpenShop Foundation online store, without prejudice to any technical or typographical errors caused by a human or technical factor.

OpenShop Foundation reserves the right to change the content of its website at any time without notice.

Verification of the technical information provided and the appropriateness of the items ordered are the sole responsibility of the customer using the website. OpenShop Foundation assumes no responsibility for any product incompatibilities with other products.

2. Limitation of Liability

OpenShop Foundation disclaims any responsibility for any technical issues that may occur when users attempt to access the website openshop.gr and during this access and is related to the operation or compatibility of their infrastructure with the use of the website.

OpenShop Foundation bears no responsibility for any direct or indirect, positive or consequential damages that may result from the inability of website usage, as well as any errors, interruptions, defects or delays in the operation of the website or the transmission of information through it.

OpenShop Foundation has no responsibility for acts or omissions of third parties, particularly unauthorised third party interventions to products and/or services and/or information available through it.

3. User Statements

The User declares that all information provided by him while using the website is accurate. The User undertakes to cover any damage to the OpenShop Foundation or affiliate companies by the use of the Website and the User Account by unauthorised persons.

The User is solely responsible for evaluating and selecting the products and services offered by the Website.

OpenShop Foundation assumes no responsibility for the correctness of the User's choice or any incompatibilities between chosen products - software - services provided by it.

The User declares that it will not use the Website to send, publish or transmit any content that is illegal, harmful, threatening, offensive, annoying, defamatory, vulgar, obscene, libellous, violates someone else's privacy, expresses empathy, or expresses racial, ethnic, or other discrimination, may cause harm to minors in any way, is not entitled to be transmitted in accordance with law or contractual or management relations (such as inside information, proprietary and confidential information acquired or disclosed as part of employment relationships or subject to confidentiality agreements), infringes any patent, trademark, trade secret, copyright or other proprietary rights of third parties, contains software viruses or any other codes, files or programs designed to interrupt, damage, destroy, or interfere with the operation of any computer software or hardware, intentionally or unintentionally violate applicable Greek and Community legislation and provisions, may harass third parties in any way and any content used to collect or store users' personal data.

4. Order placement

To place an order, select the product and service codes from the product and service directory or search for products and services and put them in the shopping cart. Fill in the details of the order, such as the payment method, shipping method, shipping and invoicing address, if needed, and any notes/comments you may have on order fulfilment.

After the placement of the order, you will receive an automated email message detailing the details of your order. After processing the order and the collection of products takes place the final confirmation of availability. During the progress of the order, you will receive a series of automated emails, describing the progress of the order until it is completed. In the event of any pending issue during the execution of the order, you will receive a corresponding email message. Alternatively, we will contact you by phone.

5. Order change or cancellation

If the order has been completed but not yet shipped, you can contact our Partner Service Department and ask to cancel or change the order. If the order has been shipped or has begun its shipment, that has left the OpenShop Foundation warehouse, contact our Partner Service Department for information on the available options.

If, upon ordering, we find that the ordered goods or services are no longer available, without our own fault or if they have not been delivered by the manufacturer, without our own fault, or due to force majeure or unforeseen obstacles it is not possible to execute the order we immediately inform the buyer about the unavailability and consider, together with the buyer, the possibility of supply of goods or services of equivalent quality and price of services. If the buyer rejects the equivalent offer or is not interested in an equivalent offer, it has the right to withdraw from the contract. If the buyer withdraws from the contract, payments already received by us will be refunded to the buyer immediately.

6. Payment methods

You can pay the order by any of the following payment methods:

Payment by credit card: Pay the order through the secure environment of Viva Wallet. You will be prompted to enter the name of the holder and the card number, the three-digit CVV number printed on the back of the card as well as the expiration date. Accepted cards are Visa, Mastercard, Maestro, Diners Club and American Express, regardless of the issuing bank.

Pay by bank deposit/wire transfer : Pay the order in one of the following bank accounts:

7. Retention of title

The delivered goods remain in the ownership of the OpenShop Foundation business until their full payment. During this period, the Buyer may not assign, process, remodel or bind any goods and/or objects from them without the consent of OpenShop Foundation as security. The buyer is obliged to handle the goods with care as long as they remain the property of the OpenShop Foundation.

8. Estimated order execution time

Delivery time depends on the availability of products and the chosen payment method. Orders placed on weekdays, except Saturdays, Sundays and public holidays, until 13:00 and on condition that the products are available and all financial obligations have been settled, are usually delivered on the next business day in the city of Athens and within two business days in most central areas. In the islands, in remote areas and most European locations, orders are delivered within three to five business days. Exceptions are products that are expected and/or are available on request, for which there is separate delivery information. The above deadlines do not apply in periods of extreme weather or strikes, and in any case of force majeure, which may affect delivery times. There is the possibility of partial shipment of individual products in one order.

9. Shipping methods

The goods can be shipped in the following three ways:

Delivery via shipping selection by OpenShop: The shipping is assigned to cooperating transport companies. The customer requests a quote on the cost of shipping through the order form and is promptly informed of the shipping cost via e-mail. If the customer accepts the shipping cost, they can complete their order through the order form. The goods are delivered on the ground floor of the recipient's shipping address without obligation to carry upstairs, and the recipient is obliged to collect them to that place and to bring them to their destination by its own means.

By my own shipping: For shipment of the order with the customer's shipping option, the customer selects "By my own shipping" through the order form. When the customer completes the order, it is informed by email about the days and hours where the customer's shipping company may collect the order.

Pick up in-store: In order to collect the order from the physical store, the customer selects “Pick up in-store” through the order form. Upon completion of the order, the customer will be notified by email about the days and hours she/he may collect the order. To receive goods from the physical store requires a prior order.

10. Return due to incorrect product delivery

If the product we shipped to you is different from what you ordered, you may return it free of charge within ten (10) business days of its delivery to you. In this case, the product can be returned only if it is in its original state and with the original packaging complete and intact. Returns for these cases are at our own expense, provided that you have contacted our Partner Service Department in order to ship the correct product to you.

11. Return due to a defective claim

If you would like to return a product you purchased because you think it is defective, please contact our Partner Service Department to inform us and receive all the necessary information. If a product has been declared defective by you, our company expressly reserves the right to have the product previously diagnosed as defective by the competent technicians. If competent technicians do not diagnose a defect, there may be diagnostic charges. You will be informed in advance about possible charges when contacting our Partner Service Department. Shipments to and from the Partner Service Department are at your own expense.

12. Data protection

OpenShop Foundation respects personal data and manages it in accordance with the obligations set by the European Parliament's Regulation 2016/679 and the applicable national data protection law L.4624/2019. To this end, it has made considerable efforts to take all preventive measures to preserve the confidentiality and security of personal data and to prevent leaks, deterioration, damage, loss, transmission and access by unauthorised third parties and any other unfair treatment.

13. Applicable law:

The contract is governed by Greek law. The Athens Courts are responsible for any dispute.
